Process
servers in Florida are governed by the Florida
Rules of Civil Procedure which were
adopted from the Federal
Rules of Civil Procedure. Of course,
the rules are different from state to
state. Florida statutes do not allow
service of process on Sundays and in
some states service of process is
disallowed on holidays and election
days.
Each
state jurisdiction has its own rules
regarding the means by which service of
process can be achieved. Usually, a
legal document such as a summons must
be served directly to a
defendant personally. Other procedures
allow that a person at the persons home
or employment may be served so long as
they are of suitable age, discretion or
a cohabiting adult. Sometimes, service
of process may also be in the form of
mail in which the defendant must sign
and acknowledge an acceptance of service
and mail it back to the administrative
body, court or tribunal that issued it.
In some instances, service can be
achieved through procedural rule or by
court order via publication.
